As a home buyer or seller, you have the benefit of hiring a real estate professional to provide support and protect your best interests. Merely meeting with real estate agents does not ensure they represent you. There is typically an agreement formalizing the relationship, roles of real estate agents, and your obligations. Below are important details on why you should use a real estate agents.

Real Estate Agents Fiduciary

Federal law requires that agents provide certain responsibilities to their clients after they enter into an agency relationship.

Reasonable Care

Real estate professionals have a reasonable amount of training when it comes to real estate issues and on the real estate procedures, but they are not experts in all real estate related fields (such as legal issues). For information outside of their knowledge, they must direct clients to appropriate experts.

All real estate agents must provide information on everything they know about a listing,…usually referred to as material facts. The responsibility to disclose also covers any details that may impact decisions about a home or improve negotiating position.

Maintaining Confidentiality

Real estate agents must maintain confidentiality of client information. They must not disclose information about your business, finances, or motivations unless requested by you or mandated by a court to do so. This duty remains intact beyond any closings or contracts.

Agents must perform responsibilities and honor requests in a reasonable time frame. This may be critical in multiple offer scenarios. This is also critical once a property is under agreement and must meet certain deadlines.

Real Estate Agents must retain the best interests of their clients above any other individuals, including themselves. Earnings, particularly in competing offer situations, must not be an influence and would otherwise be disloyal. Confidentiality is also a facet of loyalty.

Agents must accurately follow the transfer of all funds pertaining to a home sale or purchase. This includes security deposits given and the release of such deposits where necessary.

Lawful Obedience

Agents must respect their clients’ instructions, as long as the actions do not violate any laws or contracts. For instance, sometimes clients ask agents to write a contract with terms that the agent does not agree with. Agents must comply with those requests even if they have a disagreement.

Why You Should Use A Real Estate Agents

Selecting a real estate agent has many benefits. Beyond what is mentioned above, real estate agents have an even more important task of controlling interactions between parties. The home buying and selling process can be very complicated. Having the advice of an individual that will protect your best interests but is emotionally detached will facilitate the process and lead to beneficial results.
